1. Introduction and Commitment

1.1 Purpose This Website Accessibility Policy (“Policy”) establishes Pinkbyte Inc.’s (“Company,” “we,” “our,” or “us”) commitment to ensuring digital accessibility for people with disabilities. The Company is committed to ensuring that its websites, web applications, and digital content are accessible to all users, including those with disabilities, in accordance with applicable laws and regulations, including but not limited to the Accessibility for Ontarians with Disabilities Act, 2005 (“AODA”), the Integrated Accessibility Standards Regulation (“IASR”), the Ontario Human Rights Code, the Canadian Human Rights Act, and the Accessible Canada Act. 1.2 Scope of Policy This Policy applies to all websites, web applications, and digital content owned, operated, or controlled by Pinkbyte Inc., including but not limited to www.pinkbyte.com and www.mazzzing.com (collectively, the “Websites”). This Policy applies to all employees, contractors, vendors, and third parties who develop, maintain, or contribute to the content and functionality of our Websites. 1.3 Commitment Statement Pinkbyte Inc. is committed to ensuring that our Websites are perceivable, operable, understandable, and robust for all users, including those with disabilities. We strive to ensure that our Websites comply with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards, which exceed the current AODA requirement of WCAG 2.0 Level AA compliance. We are dedicated to providing an inclusive digital experience that accommodates the diverse needs of all our users.

2. Accessibility Standards

2.1 Compliance Target Pinkbyte Inc. aims to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards for all of its Websites. This commitment exceeds the current AODA requirement of WCAG 2.0 Level AA compliance by January 1, 2021, for all public websites and web content published after January 1, 2012. 2.2 Key Accessibility Features In accordance with WCAG 2.1 Level AA standards, our Websites shall incorporate, but not be limited to, the following key accessibility features: a)Perceivable Content: Text alternatives for non-text content; captions and alternatives for multimedia; content that can be presented in different ways; content that is distinguishable with adequate color contrast. b)Operable Interface: All functionality available from a keyboard; users have enough time to read and use content; content that does not cause seizures or physical reactions; navigable content with multiple ways to find pages; input methods beyond keyboard. c)Understandable Information: Readable and understandable text; content that appears and operates in predictable ways; input assistance to help users avoid and correct mistakes. d)Robust Content: Content that is compatible with current and future user tools, including assistive technologies. 2.3 Compliance Timeline Pinkbyte Inc. has established the following timeline for achieving and maintaining WCAG 2.1 Level AA compliance: a)Initial Assessment: Completed prior to the effective date of this Policy. b)Implementation of Accessibility Features: Ongoing process with priority given to high-traffic pages and essential functionality. c)Full Compliance Target: January 1, 2024, for all existing content on our Websites. d)New Content: All new content published after January 1, 2024, shall comply with WCAG 2.1 Level AA standards at the time of publication.

3. Accessibility Testing and Evaluation

3.1 Testing Commitment Pinkbyte Inc. commits to conducting annual comprehensive accessibility testing of its Websites to ensure ongoing compliance with WCAG 2.1 Level AA standards. The first accessibility audit will be conducted no later than January 1, 2026. 3.2 Testing Methodology Our accessibility testing shall include, but not be limited to: a)Automated Testing: Utilizing industry-standard automated accessibility testing tools to identify potential accessibility issues. b)Manual Testing: Conducting manual reviews by trained personnel to identify issues that automated testing may not detect. c)User Testing: When feasible, engaging users with disabilities to provide feedback on the accessibility of our Websites. d)Code Review: Reviewing website code to ensure it meets accessibility standards. 3.3 Testing Documentation Pinkbyte Inc. shall maintain detailed records of all accessibility testing conducted, including: a)Testing dates and methodologies employed; b)Issues identified and their severity; c)Remediation plans and timelines; d)Verification of issue resolution. These records shall be maintained for a minimum of three (3) years and shall be made available upon request to regulatory authorities or as required by applicable law.

4. Accessibility Issue Reporting and Remediation

4.1 Feedback Mechanism Pinkbyte Inc. provides a dedicated contact form on its Websites for users to report accessibility issues, request accessible formats of content, or provide feedback regarding the accessibility of our Websites. This contact form shall be prominently displayed and accessible from all pages of our Websites. 4.2 Response Timeline Pinkbyte Inc. commits to the following response timeline for accessibility issues: a)Initial Acknowledgment: Within twenty-four (24) hours of receiving a report of an accessibility issue, Pinkbyte Inc. shall acknowledge receipt of the report. b)Assessment: Within five (5) business days of receiving a report, Pinkbyte Inc. shall assess the reported issue and determine its validity, severity, and estimated time for remediation. c)Remediation: Pinkbyte Inc. shall address and remediate valid accessibility issues within sixty (60) business days of receiving the report, subject to the complexity and scope of the issue. d)Communication: Pinkbyte Inc. shall provide regular updates to the reporting party regarding the status of the remediation efforts. 4.3 Prioritization of Remediation Pinkbyte Inc. shall prioritize the remediation of accessibility issues based on the following factors: a)Severity: The degree to which the issue impacts the ability of users with disabilities to access and use the Websites. b)Scope: The number of pages or features affected by the issue. c)Frequency of Use: The frequency with which the affected page or feature is accessed by users. d)Complexity: The technical complexity of implementing the remediation. 4.4 Temporary Accessibility Failures In the event of temporary accessibility failures due to maintenance, updates, or unforeseen technical issues, Pinkbyte Inc. shall: a)Provide clear notice on the affected pages regarding the temporary inaccessibility; b)Include an estimated timeline for restoration of accessibility; c)Offer alternative means of accessing the information or services, where feasible; d)Restore accessibility as expeditiously as possible.

5. Accessibility Support and Assistance

5.1 Support Availability Pinkbyte Inc. provides email-only support for accessibility issues during the hours of 9:00 a.m. to 5:00 p.m. Eastern Standard Time (EST), Monday through Friday, excluding Canadian statutory holidays. 5.2 Contact Information Users may contact Pinkbyte Inc. regarding accessibility issues through the following channels: a)Email: ariana.stultz@pinkbyte.com b)Contact Form: Available on all pages of our Websites c)Mailing Address: 107 Mary St, Milton, Ontario, L9T 1L8, Canada 5.3 Alternative Formats Upon request, Pinkbyte Inc. shall provide website content in alternative accessible formats within a reasonable timeframe, not to exceed fifteen (15) business days from the date of the request, unless a longer period is necessary due to the complexity or volume of the requested content. 5.4 Documentation of Accessibility Features Pinkbyte Inc. shall maintain documentation of the accessibility features of its Websites, which shall be provided upon request to users, regulatory authorities, or as required by applicable law.

6. Third-Party Content and Services

6.1 Third-Party Content Disclaimer Pinkbyte Inc.’s Websites may contain content, applications, or services provided by third parties that are not under the control of Pinkbyte Inc. While we strive to ensure that all content on our Websites is accessible, we cannot guarantee that third-party content, applications, or services will be fully accessible or compliant with WCAG 2.1 Level AA standards. 6.2 Third-Party Content Evaluation Pinkbyte Inc. shall make reasonable efforts to evaluate the accessibility of third-party content, applications, or services before incorporating them into our Websites. Where feasible, we shall select third-party providers that demonstrate a commitment to accessibility. 6.3 Reporting Third-Party Accessibility Issues If a user encounters accessibility issues with third-party content, applications, or services on our Websites, they are encouraged to report these issues through our accessibility feedback mechanism. Pinkbyte Inc. shall make reasonable efforts to work with the third-party provider to address the reported issues. 6.4 Alternative Access Where third-party content, applications, or services cannot be made fully accessible, Pinkbyte Inc. shall, where feasible, provide alternative means of accessing the information or services.

7. Procurement and Development

7.1 Accessibility in Procurement Pinkbyte Inc. shall evaluate the accessibility of digital products, services, and content on a case-by-case basis before procurement. Where feasible, we shall select vendors and products that demonstrate a commitment to accessibility and compliance with WCAG 2.1 Level AA standards. 7.2 Accessibility in Development Pinkbyte Inc. shall incorporate accessibility considerations throughout the development lifecycle of its Websites, including: a)Planning: Identifying accessibility requirements during the planning phase. b)Design: Creating designs that incorporate accessibility features and comply with WCAG 2.1 Level AA standards. c)Development: Implementing code that supports accessibility and is compatible with assistive technologies. d)Testing: Conducting accessibility testing throughout the development process. e)Maintenance: Ensuring that accessibility features are maintained during updates and modifications. 7.3 Developer Resources Pinkbyte Inc. shall provide optional accessibility resources to its development team, including: a)Access to accessibility guidelines and best practices; b)Information about assistive technologies; c)Tools for testing accessibility; d)Opportunities for accessibility training.

8. Mobile Access

8.1 Desktop-First Approach Pinkbyte Inc. primarily focuses on desktop accessibility for its Websites, while making reasonable efforts to ensure that mobile versions of our Websites are also accessible. Users may experience optimal accessibility when accessing our Websites from desktop or laptop computers. 8.2 Mobile Compatibility While our primary focus is on desktop accessibility, Pinkbyte Inc. shall make reasonable efforts to ensure that our Websites are compatible with mobile screen readers and other mobile assistive technologies. We shall test our Websites on common mobile platforms and make adjustments as necessary to improve mobile accessibility. 8.3 Mobile Accessibility Limitations Pinkbyte Inc. acknowledges that there may be limitations to the accessibility of our Websites on mobile devices due to the inherent constraints of mobile platforms and the diversity of mobile devices and operating systems. We shall clearly communicate any known mobile accessibility limitations on our Websites.

9. Communication and Training

9.1 Communication of Policy This Policy shall be made publicly available on our Websites and shall be communicated to all employees, contractors, vendors, and third parties who develop, maintain, or contribute to the content and functionality of our Websites. 9.2 Updates and Changes Pinkbyte Inc. shall communicate updates to this Policy and major changes to the accessibility features of our Websites through: a)Updates to this Policy document; b)Notices on our Websites, where appropriate; c)Direct communication to relevant stakeholders. 9.3 Training Resources Pinkbyte Inc. shall provide optional accessibility resources to its team members, including: a)Information about this Policy and its requirements; b)Resources for understanding web accessibility principles; c)Guidelines for creating accessible content; d)Information about assistive technologies.

10. Compliance with Applicable Laws

10.1 AODA Compliance Pinkbyte Inc. acknowledges its obligations under the Accessibility for Ontarians with Disabilities Act, 2005 (AODA) and the Integrated Accessibility Standards Regulation (IASR), which require websites of private organizations with 50 or more employees in Ontario to conform to WCAG 2.0 Level AA by January 1, 2021, for all web content published after January 1, 2012. By targeting WCAG 2.1 Level AA compliance, Pinkbyte Inc. exceeds these requirements. 10.2 Ontario Human Rights Code Pinkbyte Inc. acknowledges its obligations under the Ontario Human Rights Code to provide equal treatment with respect to services, goods, and facilities, without discrimination because of disability. This includes providing accessible websites and digital content. 10.3 Canadian Human Rights Act Pinkbyte Inc. acknowledges its obligations under the Canadian Human Rights Act to provide equal access to services customarily available to the general public, without discrimination based on disability. This includes providing accessible websites and digital content. 10.4 Accessible Canada Act Pinkbyte Inc. acknowledges the principles and requirements of the Accessible Canada Act and is committed to identifying, removing, and preventing barriers to accessibility in areas under federal jurisdiction. 10.5 Other Applicable Laws Pinkbyte Inc. shall monitor and comply with all other applicable federal, provincial, and local laws, regulations, and standards related to digital accessibility.

11. Policy Review and Updates

11.1 Regular Review Pinkbyte Inc. shall review this Policy at least annually to ensure that it remains current, effective, and compliant with applicable laws, regulations, and standards. 11.2 Policy Updates This Policy may be updated from time to time to reflect: a)Changes in applicable laws, regulations, or standards; b)Advances in technology; c)Changes in best practices for digital accessibility; d)Feedback from users and stakeholders; e)Results of accessibility testing and audits. 11.3 Version Control Pinkbyte Inc. shall maintain a record of all versions of this Policy, including the dates of adoption and revision, and a summary of significant changes.

13. Definitions

13.1 “Accessibility” The degree to which a product, service, environment, or facility is usable by as many people as possible, including persons with disabilities. 13.2 “Assistive Technology” Hardware or software that acts as a user agent, or along with a mainstream user agent, to provide functionality to meet the requirements of users with disabilities that go beyond those offered by mainstream user agents. 13.3 “Disability” As defined in the Accessibility for Ontarians with Disabilities Act, 2005, means: a)any degree of physical disability, infirmity, malformation or disfigurement that is caused by bodily injury, birth defect or illness; b)a condition of mental impairment or a developmental disability; c)a learning disability, or a dysfunction in one or more of the processes involved in understanding or using symbols or spoken language; d)a mental disorder; or e)an injury or disability for which benefits were claimed or received under the insurance plan established under the Workplace Safety and Insurance Act, 1997. 13.4 “Web Content Accessibility Guidelines (WCAG)” Guidelines developed by the World Wide Web Consortium (W3C) that explain how to make web content more accessible to people with disabilities. 13.5 “WCAG 2.1 Level AA” The second level of conformance with the Web Content Accessibility Guidelines version 2.1, which includes all Level A and Level AA success criteria.

14. Severability

If any provision of this Policy, or any portion thereof, is held to be invalid, illegal, void, or unenforceable by any court or tribunal of competent jurisdiction, the remainder of this Policy shall remain in full force and effect to the maximum extent permitted by law. The parties agree that any such invalid, illegal, void, or unenforceable provision shall be modified and limited in its effect to the extent necessary to cause it to be enforceable, or if such modification is not possible, shall be deemed severed from this Policy. In such event, Pinkbyte Inc. shall replace any invalid, illegal, void, or unenforceable provision with a valid, legal, and enforceable provision that corresponds as closely as possible to the original intent and purpose of this Policy. The invalidity or unenforceability of any provision in one jurisdiction shall not affect the validity or enforceability of such provision in any other jurisdiction.

15. Governing Law

This Policy shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law provisions. Any disputes arising under or related to this Policy shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
